Terms and Conditions for EucalyptVow Events

Introduction

Welcome to EucalyptVow Events. These Terms and Conditions govern your use of our services, including customized wedding planning, venue selection and decoration, bridal styling and makeup coordination, catering and menu design, entertainment and music booking, and wedding day coordination and management. By engaging with our services, you agree to comply with and be bound by these terms. Please read them carefully.

1. Service Agreement and Engagement

All services provided by EucalyptVow Events are subject to a formal service agreement or contract, which will outline the specific services, timelines, payment schedules, and other relevant details. Engagement of our services is confirmed upon signing of this agreement and payment of any stipulated deposit.

2. Payments and Fees

Fees for our services will be clearly outlined in your individual service agreement. A non-refundable deposit is typically required to secure our services. Subsequent payments will follow a predefined schedule. All prices are quoted in Australian Dollars (AUD) unless otherwise specified.

Failure to adhere to the payment schedule may result in a suspension or termination of services, at the discretion of EucalyptVow Events.

3. Cancellations and Refunds

Cancellation policies are detailed within your specific service agreement. Generally, deposits are non-refundable. Should you cancel services, a cancellation fee may apply, proportionate to the work completed and expenses incurred up to the date of cancellation. Refund eligibility will be at the sole discretion of EucalyptVow Events and will be based on the terms outlined in your contract.

In the unlikely event that EucalyptVow Events needs to cancel a service due to unforeseen circumstances, all payments made for unrendered services will be fully refunded, or alternative arrangements offered.

4. Client Responsibilities

Clients are required to provide timely and accurate information necessary for the provision of services. This includes, but is not limited to, guest lists, specific preferences, and vendor choices. Prompt decision-making and communication are crucial for successful event execution. Delays caused by the client may impact timelines and service delivery.

Clients are responsible for informing EucalyptVow Events of any changes to their preferences or requirements promptly.

5. Third-Party Vendors

EucalyptVow Events often liaises with and recommends third-party vendors (e.g., caterers, florists, entertainment). While we strive to work with reputable professionals, we are not responsible for the direct actions, omissions, or liabilities of these third-party vendors. Any contracts or agreements entered into directly between the client and a third-party vendor are the sole responsibility of those parties.

We will, however, assist in resolving any issues that may arise with recommended vendors where reasonably possible.

6. Limitation of Liability

EucalyptVow Events will perform its services with reasonable care and skill. However, EucalyptVow Events shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Our total liability to you for any claim arising out of or in connection with the services provided shall not exceed the total fees paid by you for the specific services giving rise to the claim.

7. Intellectual Property

All content, designs, concepts, and materials created by EucalyptVow Events for your event remain the intellectual property of EucalyptVow Events. Usage of such materials outside the scope of the agreed-upon event without prior written consent is strictly prohibited.

We may use photographs or videos of your event for promotional purposes, provided consent has been obtained.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Any dispute arising under these Terms and Conditions will be subject to the exclusive jurisdiction of the courts located in Brisbane, Queensland, Australia.

9. Amendments to Terms

EucalyptVow Events reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on our online platform, and where applicable, clients with ongoing service agreements will be notified directly. Continued engagement with our services after such amendments constitutes your acceptance of the new terms.
